Your Rights Under the FDCPA
The Fair Debt Collection Practices Act (FDCPA) protects you from unfair or abusive debt collection. Here's what you need to know.
Right to Dispute
You have 30 days from your first contact to dispute the debt in writing. We must pause collection activity and verify.
No Harassment
Debt collectors cannot use threats, obscene language, or engage in any form of harassment or abuse.
Calling Hours
Collectors may only call between 8:00 AM and 9:00 PM in your local time zone — no exceptions.
Cease Contact
You may request in writing that a collector stop contacting you. We must honor that request.
Written Validation
Within 5 days of first contact, collectors must send a written notice with amount owed and creditor info.
Privacy Protection
Collectors cannot discuss your debt with unauthorized third parties or publicize your debt.
Truthful Communication
Collectors cannot misrepresent the amount owed, falsely threaten lawsuits, or impersonate attorneys.
Right to Sue
If a collector violates the FDCPA, you may sue for damages. You have one year from the date of the violation.
Report a Violation
If you believe your rights have been violated, contact the FTC at ftc.gov or your state attorney general.
